TERMS AND CONDTIONS
All reservations are subject to a $75.00 (plus tax) booking charge covering our administrative costs. This fee is non-refundable.
Credit Card Fees, Wire Transfer Bank Fees as well as Pay Pal Charges have to be paid by the renter. There is a processing charge for payments by credit card.
PAYMENT TERMS AND CONDITIONS:
A 30% non-refundable reservation deposit is required and will be applied against the total amount due. The final rental payment is due 45 days prior to Guest arrival and is non-refundable at that point. Should the 45 day deadline fall on a Saturday, Sunday, or Holiday, the final rental payment will be charged on the last business day prior to the 45 day deadline.
All rates are plus 11% tax (6% Sales Tax and 5% Tourist Tax).
With this signature I authorize MHB Property Management, Inc. to deduct the reservation deposit when the reservation is booked and rental balance as well as a credit card fee of 2.75 % of the total balance 45 days prior to arrival date.
I also authorize MHB Property Management Inc. to charge my Credit Card for any and all damages or electric charges ($25.00 are included per week) that my accompanying party or I cause during my stay at the above mentioned rental property up to the amount of $ 1,500.–
CANCELLATIONS AND REFUNDS:
The renter may cancel the rental contract at any time, as long as the cancelation is sent to us in writing. The following deadlines and costs apply to cancelations by the renter:
Cancellations within three days of date when booking was made: $75.00 (plus tax) administrative fee.
Cancellations of 46 or more days prior to arrival: Down Payment is forfeited
Cancellations of 45 or less days prior to arrival: 100% of rental amount is forfeited
Shall it be necessary for MHB Property Management, Inc. to cancel the reservation for any reason; we will offer the renter a comparable or upgraded vacation home as an alternative. The renter then has the choice to accept the alternative vacation home or cancel the reservation for a full refund.
After your arrival: Should the vacation home become unsuitable for occupancy either temporary or permanently, MHB will attempt to offer a comparable or upgraded alternate vacation home. If the renter decides against the alternatively offered vacation home(s), MHB will refund an amount equal to the prorated amount of the unused vacation rental days. Any further refund is considered solely on the discretion of MHB.
Construction: Cape Coral is a highly desirable area with lots of construction. We will not move guests due to construction or noise.
SUBSTITUTIONS OF ACCOMMODATIONS:
We reserve the right to change unit assignments. When your reservation is confirmed, a unit will be assigned, however, no unit assignment request is guaranteed. If a change is made, any difference in rate is subject to guest approval. Under the rare circumstance that we will have to substitute your accommodations, we will try to either assign a similar comparable or upgraded property for the same rate.
You can go directly to the unit. You will find the key in a lockbox at the front door (lockbox code to access key will be provided with final payment confirmation). If you expect to arrive after business hours, please notify us.
Your unit can be occupied by no more than the maximum number of persons indicated on this confirmation. Occupancy is defined as any overnight stay. In the event occupancy is exceeded, guest agrees to let the owner, owner’s agent, or MHB Property Management remove them from the unit and retain all monies whether earned or unearned.
We will verify during check in and check out to check the occupancy during your stay (i.e. beds used) Please notify us in advance to approve any changes. If it is verified that more people are staying for more nights than is indicated above – or has not been approved for changes by us – we have the right to charge a rate equivalent to 6 or 8 people for the entire rental period plus a penalty of $ 500.
If it is verified that more than 6 or 8 people are staying for any nights without our prior approval, we have the right to terminate this rental contract immediately with no refund and tenants must vacate the property immediately. With this agreement between – MHB Property Management Inc. (Agent) as the representative agent of the homeowner the Owner/ Agent agrees to rent to the Guest the Real Property described hereafter as shown above.
CSA DAMAGE PROTECTION:
As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000.00. Any damages that exceed $3,000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000.00. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy, www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly MHB Property Management, Inc. any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact MHB Property Management, Inc. directly if you do not wish to participate in this assignment. If you do not wish to purchase the Vacation Rental Damage Protection, a $1,500.00 damage deposit will be required upon check-in.
SECURITY DEPOSIT (DAMAGE DEPOSIT):
We require a $1500 refundable security deposit, which is to be paid along with your final payment (45 days prior to your arrival). Security Deposit returns will be processed up to 4 weeks after your departure. For claims against the security deposit: These claims do not differentiate between accidental, inadvertent, intentional, or grossly negligent damages. All damages of any kind will be charged against the security deposit. BBQ Grill cleaning of $30 will go against your Security Deposit if grill is not cleaned properly.
ELECTRICITY CHARGES – if not paid $10.00/day up front -:
If stated on our webpage (specific house description or extra notes section at www.capecoral4vacation.com) there will be an extra charge for electricity or gas if you didn’t choose the prepaid electric. These possible charges will be charged against your credit card on file or paid in cash by the guest(s) at time of check-out. MHB Property management performs an electric meter reading on the day of your arrival, as well as a meter reading at the time of departure of the guest from the rental unit. These readings are used to calculate the electric charges. In most cases the charge is $0.14/kwh with $25/week free allowance, unless otherwise stated on our website.
CHECK-IN & CHECK-OUT PROCEDURE:
Upon arrival at your vacation home you may directly go to the home and enter with the provided lock box code (provided with full payment). Inside the house you will find a welcome letter, as well as the check-in/out protocol (including the initial electric meter reading – if applicable), please familiarize yourself with the documents upon arrival. Feel free to give us a call during our normal business hours (Mon-Fri 9am to 5pm), or for emergencies you can reach us at the phone number provided on the welcome letter.
Please contact us during your stay to set up an appointment for a check-out, at which time we will meet you at the house to check the condition of the home as well as perform the final electric meter reading (if applicable). Should you or us for some rare reason miss the appointment, we will check the home and meter without your presence and inform you of our findings and/or charge the electric usage to your credit card on file. Shortly after your departure you will receive a final invoice that will inform you of the electric charges applied to your card. Should we discover damages, we will inform you directly either via email or telephone.
At arrival, you will find a check-in/check-out protocol in the kitchen of your rental home, listing the current condition of the home, which you will need to sign. Therefore, when you arrive, please check the vacation rental for cleanliness and damage. Notify us promptly of any problems or damage. You agree to leave the vacation rental in arrival condition. No physical damage, vacation rental and yard neat and tidy, dishes washed, spills wiped up, trash in trash can, etc. Additional Cleaning Charge: $20.00 per hour.
STUDENT GROUPS ARE NOT PERMITTED:
Students unaccompanied by a parent will not be permitted to register. Any reservations obtained under false pretense will be subject to forfeiture of all monies prepaid and the party will not be permitted to occupy any unit in the MHB Property Management program.
Please note: At your arrival, please check the BBQ grill for cleanliness, the check-in/out protocol should state under condition clean, please contact us immediately if the BBQ grill is not clean. Check Propane before using BBQ grill. MHB charges a $50.00 cleaning fee for BBQ grills, which are found to be dirty at check-out.
All homes and condominium unit are individually owned and decorated and vary according to the owner’s taste. Our accommodations are complete with a fully equipped kitchen, and linens. Beach towels and beach chairs are not provided.
MAINTENANCE DURING YOUR STAY:
In the event of equipment malfunction within the unit, MHB Property Management will expedite repairs as quickly as possible. From time to time, it may be necessary to close swimming pools and other amenities for maintenance purposes. Any maintenance items should be reported to MHB Property Management as soon as possible. No rent adjustments can be made for circumstances beyond our control or for malfunction or loss of use of equipment or amenities. There is a lawnservice mowing every 1-2 weeks depending on the season.
Each property is equipped with a telephone for your convenience. There is no charge for incoming calls (not including collect calls) or outgoing local calls. Outgoing long-distance calls must be charged to a credit card or calling card, billed to your home number, or collect. You are not permitted to make calls to or from the vacation home, if these calls generate charges. A minimum-handling fee of $10.00 or actual charges will be imposed for long distance/ and other chargeable calls made to or from the vacation home phone, which ever is greater. If the phone line is open for long distance calls we will charge any long distance calls/chargeable calls to your credit card on file or against your security deposit if no credit card is on file with us.
Units are treated for pest control by contracted pest control companies. MHB Property Management will use its best efforts to address pest control concerns, but is not responsible for rebates due to the presence of pests, or in the event of untimely service by pest control companies.
Due to potential allergic reactions of future tenants, smoking is prohibited inside the majority of the units. Please identify your smoking or non-smoking preference if it is necessary for your vacation enjoyment. Violators of no smoking rules for units will be assessed additional cleaning expenses to return the unit to non-allergic status. Ashes, found inside a unit will be considered as a violation of the no-smoking policy. Damages due to smoking are not covered by the property protection fee.
Pets are only allowed at some of the properties and only when MHB Property Management gave permission. If a pet is found to be on premises, it could result in eviction and forfeiture of all monies prepaid.
ENTRY OF PREMISES:
Any authorized employee or repair person may enter the premises during customary business hours for any purpose related to the repair, improvement, care, and management of the premises.
UNITS FOR SALE:
In the event that the property, which you are renting, is listed for sale, we may need to coordinate the showing of the property during your stay. We will make every attempt to schedule the showing at a convenient time to lessen any disturbance of your vacation.
Parking areas at individual sites are for automobiles only. Motor homes, boat trailers, etc. are not permitted. Please do not park in grass areas.
MHB Property Management is not responsible for pool and spa closures at common pools (condominiums only), and no credit and/or discount can be granted for circumstances beyond MHB Property Management control.
For all single family homes the pool service has access to the pool area through the screen doors in the pool cage. Please leave these doors always unlocked. the pool is serviced once a week.
For any checks returned to us due to insufficient funds, there will be a charge for the applicable bank fees, plus a $30.00 handling fee.
A charge of $15.00 for each key and a charge of $65.00 for the garage door opener will be withheld from your deposit, if not returned to MHB Property Management upon your departure.
MHB Property Management operates under the 509 law for all short-term rentals. All rates are considered earned at the confirmed arrival date and refunds or adjustments cannot be made for late arrivals or early departures.
The laws of the State of Florida govern this agreement. The venue shall be Lee County, Florida. This agreement is binding on all parties, their heirs, successors, representatives and legal successors.
In any Litigation that results from this agreement, the prevailing party is entitled to reimbursement of all costs, including all reasonable attorney`s fees (incl. all costs and fees for appellate procedures.)
Guest is aware and understands that neither Agent, nor Owner is responsible or liable for any of Guest´s personal property present on per misses of property guest agrees to hold Agent and Owner harmless from any and all liability claims related to any injury or death while on the property. Guest accepts all risks related to, but not limited to, swimming pools, whirlpools, canals, seawalls, docks, or bicycles which may be on the property.
The house may not be sublet, or this agreement assigned without the written consent of MHB Property Management.
IMMEDIATE RESPONSE NEEDED: Report any cleaning, maintenance or site problems to MHB Property Management immediately for action by MHB Property Management staff members.
LOCK OUT CHARGE:
A charge of $20.00 will be accessed for key delivery in the event of lock out.
There will be a charge of one extra day for anyone checking out after 11:00 A.M. unless later checkout times have been approved by MHB Property Management.
MHB Property Management is not responsible at any time for any items left in any unit. If they are found by inspectors and/or cleaners, returns will be held at our office for 14 days or returned at cost plus a handling fee, not to exceed $40.00.
If you are traveling between May and November, please note that this is hurricane season. We encourage you to purchase trip insurance to protect your vacation investment since MHB will not give any refunds for vacations interrupted by hurricanes, including mandatory/voluntary evacuations.
At arrival you will find a welcome letter in the unit along with a check-in/out protocol. Please look over the letter and protocol and verify any items listed on the protocol for accuracy. In addition, please refer to the PROPERTY CONDITION/PROPERTY PROTECTION FEE section above for further instructions. Check-in/out times are listed below.
